1. Personal Information We Collect
We collect personal information in several ways, including information you provide directly, information collected automatically when you use the Services, information collected in our retail locations or at events, and information received from service providers, advertising partners, social media platforms, and other third parties.
A. Information you provide directly. We may collect information you choose to provide, including your name, email address, phone number, billing address, shipping address, account login information, order information, return and exchange information, product reviews, survey responses, promotion entries, event registrations, customer service messages, marketing preferences, and any other information you submit through the Services.
B. Order, payment, and transaction information. When you place an order or otherwise transact with us, we collect information needed to process, fulfill, ship, deliver, return, exchange, refund, or support your purchase. This may include items purchased, product preferences, order number, shipping details, billing details, payment confirmation details, fraud-prevention information, tax information, gift card information, return merchandise authorization information, and customer support history. We do not intentionally store full payment card numbers on our own systems. Payment information is processed by our payment processors, ecommerce platform providers, and related service providers.
C. Device, internet, and website activity information. When you visit or use our Services, we and our vendors may automatically collect information such as your IP address, browser type, device type, operating system, referring and exit pages, URLs, pages viewed, search terms, date and time of visit, approximate location inferred from IP address, cookie identifiers, advertising identifiers, cart activity, checkout activity, product views, clicks, and interactions with our emails, advertisements, and website features.
D. Cookies, pixels, tags, and similar technologies. We use cookies, pixels, tags, web beacons, local storage, software development kits, and similar technologies to operate our website, remember preferences, support ecommerce functionality, keep your cart active, enable checkout, prevent fraud, analyze traffic, measure marketing performance, personalize content, and support advertising. These technologies may be provided by Kimes Ranch, Shopify, analytics providers, advertising networks, social media platforms, email and SMS providers, returns and order tracking providers, fraud-prevention providers, review providers, and other vendors.
E. Account and customer profile information. If you create or use a customer account, we may collect account registration information, login information, order history, saved addresses, preferences, account settings, authentication information, and related customer account activity.
F. Marketing and communications information. If you sign up for email, SMS, or other marketing, we may collect contact information, consent status, subscription source, communication preferences, message engagement, unsubscribe activity, and related analytics. Marketing consent is not required to make a purchase.
G. Store locator and location-related information. If you use our store locator or location-based features, we may process the location you enter and, if enabled through your browser or device, approximate or precise location information for the purpose of showing nearby stores or services. You may disable location sharing through your browser or device settings.
H. Retail, event, and offline information. If you visit our retail stores, attend events, participate in promotions, contact customer service by phone, or otherwise interact with us offline, we may collect information such as your name, contact information, purchase information, event participation information, customer service notes, and other information needed to provide service or administer the interaction.
I. Social media and third-party platform information. If you interact with us on social media or through third-party platforms, we may receive information from those platforms, such as your username, profile information, comments, messages, interactions, ad engagement, or other information made available by the platform according to your settings and the platform’s policies.
J. Sensitive personal information. We do not seek to collect sensitive personal information unless reasonably necessary for a permitted purpose or with your consent where required. Sensitive personal information may include account login credentials, government identifiers (for fraud detection), or other information treated as sensitive under applicable law. We do not use sensitive personal information to infer characteristics about you.
2. How We Use Personal Information
We may use personal information for the following purposes:

- 2. To process orders, payments, shipping, delivery, returns, exchanges, refunds, gift cards, warranties, and customer support.

3. How We Disclose Personal Information
We may disclose personal information to the following categories of recipients:
A. Service providers and processors. We disclose personal information to vendors and service providers that help us operate our business and provide the Services, including ecommerce platform providers, hosting providers, payment processors, shipping carriers, fulfillment providers, returns providers, order tracking providers, fraud-prevention vendors, analytics providers, email and SMS providers, customer service tools, marketing platforms, cloud service providers, IT and security providers, professional advisors, and other operational vendors.
B. Shopify and ecommerce-related providers. Our online store is hosted on Shopify. Shopify and related Shopify services may process personal information to provide ecommerce, checkout, payment, account, analytics, fraud-prevention, privacy, and operational functionality. Shopify may also provide customer privacy tools, pixels, and checkout-related services.
C. Payment processors, financial institutions, and fraud-prevention providers. We disclose transaction and payment-related information as needed to process payments, prevent fraud, manage chargebacks, verify transactions, and comply with payment network rules.
D. Shipping, logistics, returns, and order tracking providers. We disclose information such as your name, shipping address, order details, email address, phone number, tracking number, and return information to provide delivery, order tracking, returns, exchanges, and related customer service.
E. Marketing, analytics, and advertising partners. We may disclose or make available device identifiers, internet activity, purchase activity, hashed contact information, or similar information to advertising networks, analytics providers, social media platforms, and marketing partners to measure campaigns, build audiences, personalize ads, and improve marketing. Depending on the law in the state in which you reside, this activity may be considered “sale,” “sharing,” targeted advertising, or cross-context behavioral advertising even when no money is exchanged.
F. Social media and third-party platforms. If you interact with us through a social media platform or third-party service, information may be disclosed to or collected by that platform according to its own terms and privacy policy.
G. Affiliates and business partners. We may disclose information to our present or future affiliates, related entities, parents, subsidiaries, other companies under common control and ownership, and business partners for legitimate business purposes consistent with this Privacy Policy.
H. Legal, compliance, safety, and enforcement recipients. We may disclose information to law enforcement, courts, regulators, government authorities, legal counsel, auditors, insurers, or other parties when we believe disclosure is necessary to comply with law, respond to legal process, enforce our rights, investigate fraud or security issues, or protect the rights, property, or safety of Kimes Ranch or others.
I. Business transfer recipients. We may disclose or transfer personal information in connection with a merger, acquisition, financing, reorganization, bankruptcy, sale of assets, transfer of business, due diligence process, or similar transaction, and that recipient may use your personal information for their own purposes.
J. With your direction or consent. We may disclose information when you direct us to do so or when you consent.
4. Cookies, Pixels, Analytics, and Interest-Based Advertising
Our Services use cookies, pixels, tags, web beacons, local storage, and similar technologies for essential, functional, analytics, personalization, advertising, and social media purposes. These technologies collect information about your device, browser, interactions, pages viewed, products viewed, cart activity, checkout activity, purchases, search terms, referring pages, and ad interactions.
We use analytics and advertising services to help us understand how users interact with the Services, measure marketing campaigns, show ads, limit ad frequency, personalize ads, and understand whether ads led to website visits or purchases. These services may associate your activity on our Services with activity on other websites, apps, or platforms.
You can control cookies through your browser settings and through our cookie banner, cookie preferences link, and “Your Privacy Choices” link. Some features of the Services may not function properly if cookies are disabled.
Some browsers or extensions allow you to send opt-out preference signals, including the Global Privacy Control signal (“GPC”). Where required by applicable law, we will treat recognized opt-out preference signals as a request to opt out of sale, sharing, or targeted advertising for the browser or device sending the signal. If you choose to use the GPC signal, you will need to turn it on for each supported browser or browser extension you use. Please note that your opt-out choice will only apply to your use of our Services through the current browser or device you are using.
Some internet browsers incorporate a “Do Not Track” feature that signals to websites you visit that you do not want to have your online activity tracked. Given that there is not a uniform way that browsers communicate the “Do Not Track” signal, the Services do not currently interpret, respond to, or alter their practices when they receive “Do Not Track” signals.
5. “Sale,” “Sharing,” and Targeted Advertising
We do not sell personal information for money. However, certain state privacy laws define “sale,” “sharing,” or “targeted advertising” broadly. Our use of advertising cookies, pixels, analytics tools, social media integrations, and marketing technologies may be considered a sale, sharing, targeted advertising, or cross-context behavioral advertising under some state laws.
You may opt out of these activities by using our “Your Privacy Choices” link, adjusting cookie preferences using our cookie preferences link, or enabling a recognized browser-based opt-out preference signal such as GPC.
We do not knowingly sell or share personal information of consumers under 16 years of age.
6. Your Privacy Rights
Depending on where you live, you may have one or more of the following rights, subject to legal limitations and verification requirements:
- 1. Right to know or access. You may request that we confirm whether we process your personal information and provide access to certain personal information we maintain about you.
- 2. Right to data portability. You may request a copy of certain personal information in a portable format.
- 3. Right to correction. You may request that we correct inaccurate personal information.
- 4. Right to deletion. You may request that we delete personal information we collected from or about you, subject to exceptions.
- 5. Right to opt out of sale, sharing, or targeted advertising. You may request to opt out of certain disclosures or processing for sale, sharing, targeted advertising, or cross-context behavioral advertising.
- 6. Right to opt out of certain profiling. You may opt out of profiling that produces legal or similarly significant effects. We do not engage in profiling and, therefore, do not offer this right.
- 7. Right to limit use or disclosure of sensitive personal information. You may request that we limit the use or disclosure of sensitive personal information to permitted purposes. We do not use sensitive personal information in such a way as to trigger this right.
- 8. Right to appeal. Residents of certain states may appeal our decision regarding a privacy rights request.
- 9. Right not to be discriminated against. We will not unlawfully discriminate against you for exercising your privacy rights.
Some state laws provide additional privacy rights. Because we are not subject to those laws, we have not listed them here.

Please include your full name, email address, state of residence, the right you wish to exercise, and enough information for us to verify and process your request. We may need to verify your identity before completing certain requests. Verification may require matching the information you provide with information we already maintain.
You may use an authorized agent to submit a request where permitted by law. We may require proof that you authorized the agent to act on your behalf and may also require you to verify your identity directly with us.
If we deny your request in whole or in part, residents of states that provide an appeal right may appeal by replying to our decision email and stating “Privacy Appeal” in the subject line. We will process state privacy requests in accordance with applicable law. If a state law does not apply to us or to a particular request, we may still respond voluntarily or provide reasonable assistance, but doing so does not waive any legal position.
8. California Privacy Notice
This section applies to California residents and supplements the rest of this Privacy Policy. The California Consumer Privacy Act, as amended by the California Privacy Rights Act (“CCPA”), requires specific disclosures about personal information we collect, use, disclose, sell, or share.
Categories of personal information collected. In the preceding 12 months, we collected the following categories of personal information: identifiers; customer records information; commercial information; internet or other electronic network activity information; geolocation information; audio, electronic, visual, or similar information when you contact us or interact with certain features; inferences; and sensitive personal information where necessary for permitted purposes.
Sources of personal information. We collect personal information from you, your device or browser, Shopify and ecommerce services, payment processors, shipping and returns providers, marketing and advertising partners, analytics providers, social media platforms, service providers, affiliates, business partners, and publicly available sources.
Business and commercial purposes. We collect and use personal information for the purposes described in Sections 1 and 2 of this Privacy Policy.
Disclosures for business purposes. In the preceding 12 months, we disclosed the categories of personal information listed above to service providers, processors, contractors, affiliates, payment processors, shipping providers, returns providers, analytics providers, marketing providers, advertising partners, professional advisors, legal and compliance recipients, and business transfer recipients. We disclosed the categories of personal information for the purposes described in Section 3 of this Privacy Policy.
Sale or sharing. In the preceding 12 months, we sold or shared identifiers, internet or other electronic network activity information, commercial information, and inferences with advertising, analytics, and social media partners for advertising, analytics, measurement, and personalization purposes. We do not knowingly sell or share personal information of consumers under 16.
Sensitive personal information. We do not use or disclose sensitive personal information for purposes that would require a right to limit under the CCPA, unless we provide a specific notice and choice.
California rights. California residents may request to know, access, correct, delete, opt out of sale or sharing, limit certain uses of sensitive personal information where applicable, and not be discriminated against for exercising their rights. Please see Sections 5, 6, and 7 for more information on how to exercise your rights.
Shine the Light. We do not disclose personal information to third parties for their direct marketing purposes. Accordingly, we have no obligations under California Civil Code § 1798.83.
9. Canadian Residents
Depending on the jurisdiction in which you are located, you may have some or all of the following rights with respect to your personal information:
- access/port your personal information;
- correct your personal information;
- delete your personal information;
- not be subject to automated decision-making; and
- request that we cease disseminating your personal information, or that hyperlinks providing access to your personal information be de-indexed or re-indexed.
If you would like to exercise your rights, please see Section 7 of this Privacy Policy. We do not engage in automated decision-making, and we do not disseminate personal information in violation of law or court order or in such a way as to cause serious injury in relation to an individual’s reputation or privacy. Because these practices do not occur, we do not provide a means to exercise those two rights. You may withdraw your consent by submitting a request to delete as described in Section 7 of this Privacy Policy, or by opting out of tracking technologies as discussed in Section 5 of this Privacy Policy. We will process your request in accordance with applicable legal requirements. You may submit questions or complaints regarding our privacy practices through the means described in Section 18 of this Privacy Policy.
If you are not satisfied with our response, you may file a federal complaint with the Office of the Privacy Commissioner of Canada. You may also file a complaint with the appropriate provincial privacy regulator:

If you are a resident of the province of Quebec, we may communicate your personal information to entities located outside of the province of Quebec for the purposes mentioned in this Privacy Policy. Before communicating your personal information outside of the province of Quebec, we will conduct a privacy impact assessment in accordance with any applicable legal requirements. Your personal information will only be communicated outside of the province of Quebec if the privacy impact assessment establishes that it would receive adequate protection.
10. Data Retention
We retain personal information for as long as reasonably necessary to fulfill the purposes described in this Privacy Policy, including to provide the Services, maintain customer accounts, process transactions, provide customer support, comply with legal, tax, accounting, and regulatory obligations, resolve disputes, enforce agreements, prevent fraud, maintain security, and support legitimate business operations.
Retention periods vary depending on the type of information, the purpose of collection, legal requirements, and business needs. When personal information is no longer reasonably necessary, we will delete, deidentify, aggregate, or otherwise handle it in accordance with applicable law.
11. Security
We use reasonable administrative, technical, and physical safeguards designed to protect personal information. No method of transmission, storage, or processing is completely secure. We cannot guarantee absolute security. You are responsible for maintaining the confidentiality of your account credentials and for using secure devices and networks.
12. Children’s Privacy
Our Services are intended for a general audience and are not directed to children under 13. We do not knowingly collect personal information from children under 13. If we learn that we collected personal information from a child under 13 without appropriate consent, we will take reasonable steps to delete it.
13. User Content, Reviews, and Public Submissions
If you submit product reviews, comments, photos, social media posts, contest submissions, feedback, or other content to public areas of the Services or to third-party platforms, that content may be publicly available and may be viewed, collected, and used by others. Please use caution before posting personal information publicly.
14. Third-Party Websites and Services
The Services may link to third-party websites, applications, platforms, payment services, social media pages, advertising networks, return portals, order tracking tools, or other services that we do not control. This Privacy Policy does not apply to those third-party services. We encourage you to review the privacy policies and terms of those third parties before interacting with them.
15. International Visitors
Kimes Ranch is based in the United States. If you access the Services from outside the United States, your information may be processed in the United States and other countries where our service providers operate. Privacy laws in those countries may differ from the laws where you live.
16. Financial Incentives and Loyalty Programs
We may offer discounts, promotions, rewards, loyalty benefits, sweepstakes, or similar programs that involve the collection of personal information. For example, we offer a Rewards Club that allows you to earn points for purchases and exchange them for discounts. The personal information we collect when you participate in a financial incentive includes your email address, birthday (month and day), and telephone number. Participation is voluntary. By providing your personal information during the sign-up process, you affirmatively opt in to receiving the financial incentive. You have the right to withdraw from the financial incentive at any time. If you opt out of receiving a financial incentive, we will not reduce the value of any financial incentives you previously received from us. If you wish to withdraw from receiving the financial incentive, you may submit such a request at any time by emailing us at ranchhands@kimesranch.mom.
The financial incentive is reasonably related to the value provided by your personal information. We take into consideration, without limitation, the anticipated revenue generated from such information, the anticipated expenses which we might incur in the collection, storage, and use of such information, and the anticipated expenses which we might incur related to the offer, provision, and imposition of any financial incentive. Based on this analysis, the value of your personal information that allows us to make these offers and financial incentives is the value of the offer itself.
17. Changes to This Privacy Policy
We may update this Privacy Policy from time to time. The “Last Updated” date above shows when this Privacy Policy was last revised. Changes are effective when posted unless otherwise stated. Your continued use of the Services after an updated Privacy Policy is posted means you acknowledge the updated Privacy Policy.
